United States initiates Section 301 Investigations against India
The recent U.S. Supreme Court’s decision striking down U.S. President’s “reciprocal tariffs” has shut the door on using emergency economic powers for broad, across‑the‑board import tariffs. In response, the U.S. Trade Representative (USTR) has pivoted to laws such as Section 301 of the Trade Act of 1974 to attempt to impose import restrictions.
On 11th and 12thMarch, the USTR launched two major Section 301 investigations on India and several other countries to investigate: (a) excess capacity and production in manufacturing sectors, and (b) forced labour in production processes, of these countries. These investigations cover a large majority of U.S. imports and could result in additional tariffs or import restrictions on Indian goods.
The session is focused to understand:
- the legal framework, timelines, and procedures governing Section 301 investigations,
- the range of measures the United States may adopt as a result,
- which Indian manufacturing sectors are most exposed, and
- the need for industry participation in these investigations to defend business interests.
