US Tariffs – US SC decision and way forward
The U.S. Supreme Court in its judgment in Learning Resources, Inc. v. Trump, President of the United States, has termed the “reciprocal” and “fentanyl” tariffs as illegal. These Tariffs were imposed under International Emergency Economic Powers Act (‘IEEPA’). The judgment holds that the U.S. President does not have the power to impose tariffs under the IEEPA.
Shortly after, the U.S. imposed 10% global tariffs under a different provision, and more tariffs are expected soon.
In this webinar led by Mr. V. Lakshmikumaran, Managing Partner, LKS, we shall examine the implications of this judgment and deliberate on:
- what the U.S. Supreme Court has held,
- what the outcome of the judgment means for Indian businesses,
- the implications regarding refunds for past shipments that faced “reciprocal” tariffs,
- options available to the U.S. President to impose other forms of tariffs, and
- way forward for Indian businesses.
