GCC operational playbook: Mitigating regulatory and compliance risks in India

GCCs have now evolved from cost-saving back offices into strategic centres for technology, research, analytics and customer experience. For most multinational companies, the question is no longer whether India makes sense for a GCC, the focus has shifted to how to get the legal and regulatory architecture right. The authors highlight some of the key legal issues that foreign investors commonly encounter, together with practical considerations for navigating them. They discuss issues relating to choosing the appropriate entity, maintaining corporate governance discipline, complying with FEMA and transfer pricing rules, addressing labour and employment obligations, implementing data protection frameworks, protecting intellectual property, and ensuring suitable contractual and dispute-resolution safeguards. The article stresses that proactive compliance and governance are essential for long-term success.
