The Update covers a recent decision of the Competition Commission of India (CCI) holding that the Trustees’ Association of India (TAI) and three of its members were engaged in anti-competitive conduct. It was held that the TAI along with its three members had engaged in collective price fixing by setting up a minimum benchmark fee structure for debenture trusteeship services.
Among other relevant comments, the LKS Competition Law Team observes that the CCI’s order reaffirms that it is willing to closely scrutinise cartel conduct in regulated sectors, including financial services, notwithstanding the presence of a sectoral regulator.
